ANC Procurement Advantages

  • DoW – may receive sole source direct award contracts up to $150M without a Justification & Approval.
  • Federal Civilian – may receive sole source direct award contracts up to $30M w/o a J&A.
  • Non-Protestable – sole source awards made to ANC 8(a) firms cannot be protested per 13 CFR 124.517(a).

Past Performance

  • GAO permits ANCs to claim all the experience and work history of their affiliated corporations when the proposal makes clear that the resources associated with the affiliated company/companies will have meaningful involvement in the execution of the present contract.
  • DFARS 215.305 requires affiliate company past performance to be considered, where relevant, when small business concerns bid on DoW contracts.

  • Federal: Per FAR 19.808-1(a), ANCs may receive sole source contracts up to $30M without a J&A. For acquisitions over $30M, a more streamlined J&A is required per FAR 6.303-2(d) and the approval authority is head of procurement activity per FAR 6.304(a)(3).
  • DoW: DFARS Final Rule (Federal Register ID: 2025-16205) implemented from proposed rule 2024-31570, DoW may directly award up to $150M without a Justification and Approval (J&A). This is an increase from the previous $100M threshold. For acquisitions over $150M, a more streamlined J&A is required per FAR 6.303-2(d) and the approval authority is the head of the procuring activity per DFARS 206.304(S-71).
